Elan Vital has yet to show that they operate with good faith when it comes to misuse of the DMCA to censor websites that are critical of Maharaji (Prem Rawat).

Their DMCA action neglects to consider the obvious - Fair Use.

Beyond 'Fair Use' is the need to show damages as in lost sales, for example.  The fact is that the alleged copyrighted materials on PRMI are not items in Maharaji's catalog that are for sale or if they or have been for sale they are not a substantial part of his business.  Thus, there is no financial loss that Elan Vital is suffering.  The only loss that Elan Vital and Maharaji may suffer from is the loss of cult members or prospective cult members because this vital educational information is so very effective.

Another question to ask is whether Maharaji or Elan Vital are the actual copyright owners.  In particular are vintage items that might actually belong to Sat Pal.  Also, there are time limits that allow copyright items to eventually fall into the Public Domain.
