Elan Vital Inc has failed to assert its alleged rights to copyright material on the PRMI web-site following the counter-notification issued on June 22nd, 2005. Under the DMCA provisions an entity claiming copyright has 10 business days to initiate legal proceedings following the issuance of a counter-notification.
Accordingly therefore, and as confirmed by the hosting company for the PRMI web-site, all previous images displayed on that web-site which were taken down as a result of EVI's original complaint are in the process of being re-uploaded. This will be done as soon as possible.
The authors of PRMI believe that, as with the 2003 DMCA attack by Elan Vital on the EPO web-site, the motivation of Elan Vital has little to do with any legitimate concerns over copyright. Rather Elan Vital has abused the provisions of the DMCA and World Trade Agreements in an attempt to stifle valid commentary of Prem Rawat and his organizations.
